Space Tank studio is a makerspace that provides studios, machinery and technology to the creative entrepreneurs. We foster collaboration, networking, knowledge sharing and sustainable manufacturing practices in the creative professional community.

Our website www.spacetankstudio.com.au (the “Site”) is operated and provided by Space Tank Studio Pty Ltd ACN 164 280 755 (“We,” “Us,” “the studio” ”or “Space Tank Studio”).

We aspire to do the right, ethical and legal thing in bringing you this website and our studio service. We ask that you use the same judgment as you read, use, link to, and share the content hosted on the Space Tank Studio website as well as use our studio service.

When utilizing Space Tank Studio content, we ask that you give credit where appropriate and don’t edit our content – or content that belongs to others without permission. If we’ve made an error, please let us know. You can reach us at info@spacetankstudio.com.au

Whilst we believe you will do the right thing at all times, our lawyers, and hence we, require you to accept these terms and conditions.
These are the terms and conditions of Space Tank Studio. They govern all aspects of the services provided by the studio, the website and social media sites and are designed to protect the interests of all parties concerned and activities at the studio. These include health and safety of members, tenants, management and staff, the efficiency of service as well as fairness in relation to pricing and access to space and equipment.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.

1. WHO DO THESE TERMS AND CONDITIONS APPLY TO?

1.1. These terms and conditions apply to anyone who purchases a membership, leases a studio or pays for an artist residency at Space Tank Studio.

1.2. These terms and conditions also apply to staff and management of Space Tank Studio.

2. DESCRIPTION OF SERVICE
Space Tank Studio provides studios, machinery and technology and an artist residence to the world of creators. We provide a new model of service that raises the bar on the contemporary creative studios front. We achieve this by providing a thoughtfully designed studio layout and an unparalleled range of machinery and technology directly to the creator at an affordable price.

3. GENERAL CODE OF CONDUCT AT SPACE TANK STUDIO

3.1. The general code of conduct will ensure a harmonious and safe work place. Safety and wellbeing is everybody’s responsibility.

3.2. Noisy fabrication work and use of loud machinery in the workshop is to be carried out between the hours of 8am to 5pm.

3.3. Quite work can be carried out between 7am to 11pm

3.4. Every person using the premises or the facilities must comply with Worksafe guidelines.

3.5. Any person who enters the Space Tank Studio premises, understand that they are entering a work zone where power tools and industrial machinery are in use. Caution and common sense must be used at all times.

3.6. Adequate protective gear and clothing must be worn when using machinery and power tools or when in the presence of anybody other than yourself who is using machinery and power tools.

3.7. As many artists and designers use the studio, all persons must exercise common courtesy and decency in sharing the fabrication space, machinery and equipment.

3.8. Each person using the facilities must maintain a clean and tidy work environment. This also applies to you. Think of the person who will use the space after you and clean up after yourself! Maintaining a clean, tidy and therefore safe work area is everybody’s responsibility.

3.9. Smoking and consumption of alcohol on the premises is strictly prohibited. Being under the influence of alcohol while operating machinery and power tools is strictly prohibited. Failure to adhere to this condition will result in immediate cancellation of your lease or membership with no refund.

3.10. Any disputes or grievances should be raised with Space Tank Studio management so that the best possible solution can be sought.

4. Commission

4.1. Any Space Tank Studio tenant who receives a commission resulting from the administration of Space Tank Studio PTY LTD or from the Space Tank Studio website or social media sites will attract a 10% finder’s fee payable to Space Tank Studio.

Users grant of limited licence.
You may choose to have your work displayed in the Gallery section of our website as well as having your project or work ‘featured’ on the front page of our website or social media sites. If you chose this option then the following conditions apply:
1.1. You opt to grant Space Tank Studio a limited license for the royalty-free, unrestricted, world-wide, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, distribute, perform and display Your Content (in whole or part), worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. Such license enables us to feature or use your content in promotional or marketing materials.

1.2. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of Your Content.

1.3. By granting Space Tank Studio limited licence, you also warrant that any “moral rights” in posted materials have been waived.

1.4. You acknowledge and agree that the display or use of Your Content shall be in the sole discretion of Space Tank Studio and Your Content may or may not be included on the Space tank Studio website and social media sites for any reason or no reason at all.

Refund Policy
1 Memberships: These conditions apply to all studio tenants, Workshop Pass Members and Artist Residents.

1.1. Members take full responsibility for the amount of workshop days they require. Payment of a Space Tank Studio Workshop Pass is final and non-refundable.

1.2. Limitation of usage: Machinery and technology can breakdown at any time. Consumables such as but not limited to blades, belts, drill bits, abrasives, 3D printing powder and resins and CNC laser parts have a limited life span and need replacing at times. We cannot predict when this could happen or who it might affect. For this reason we will not be held responsible for machinery and equipment down time due to maintenance or replacement.

1.3. If for reasons such as building maintenance or repair work or some unforseen reason, Space Tank Studio must limit access to fabrication space, machinery and equipment and studios then we will do everything we can to give prior warning so that members have the opportunity to adjust their schedule.

Refund Policy
This Refund Policy is applicable to purchases made from Domayne Franchisees via www.domayneonline.com.au.
For purchases made from a Domayne Franchisee in store, please see the relevant store for details.

Change of Mind
Please choose carefully as refunds are not normally provided where you have simply changed your mind, made a wrong selection or simply found the item cheaper elsewhere. We recommend you carefully preview any orders before adding them to your shopping cart and proceeding with your order.

Goods Damaged in Transit
If any goods arrive damaged, please contact the relevant Domayne Franchisee as soon as possible. The relevant Domayne Franchisee will arrange to have the damaged item returned to the Domayne Store and either replace the product or refund the price to you. Damaged goods must be returned to the relevant Domayne Franchisee in the condition received by you with all original packaging.
The “relevant Domayne Franchisee” is the Domayne Franchisee that sold and delivered the products to you.

Consumer Guarantees
Under the Competition and Consumer Act 2010 and under other consumer laws applying in each State and Territory, you have the right to have goods replaced, repaired or to receive a refund where:
• the goods are faulty;
• the goods are wrongly described;
• the goods are different from a sample shown to you; and/or
• the goods do not do what they are supposed to do.
These consumer guarantees are implied into all consumer contracts and cannot be excluded, restricted or modified. These are in addition to any voluntary warranties offered by a manufacturer.
Any shipping costs to return the original product to a relevant Domayne Franchisee will be at the cost of the relevant Domayne Franchisee, where the relevant Domayne Franchisee considers the goods to have breached a consumer guarantee. If on examination of goods returned to a relevant Domayne Franchisee are found to not be in breach of the consumer guarantees, the relevant Domayne Franchisee may charge you a fee for examining the goods, and any cost to return the goods to you.
Please note that goods must be returned within a reasonable period and you may be asked to demonstrate that the problem with the goods was not your fault.
Consumer Guarantees do not apply where in the relevant Domayne Franchisee’s reasonable opinion the goods became unacceptable due to fair wear and tear, or the customer’s misuse, failure to use the goods in accordance with manufacturer’s instructions, or failure to take reasonable care.

Refunds
Refunds will be processed by the relevant Domayne franchise and will normally be processed within 3 days

Contact
Where you have an issue relating to your Order, please immediately contact the relevant Domayne Franchisee that supplied the goods to you. Please have your Order number with you. If your issue remains unresolved after discussing it with the relevant Domayne Franchisee, please contact the Domayne Customer First Team.
This refund policy is not intended to exclude or limit any rights which you may have under the Competition and Consumer Act 2010 (Cth) or equivalent State or Territory laws.

Furniture is often large and delicate. There are many procedures in the delivery process that must be followed to ensure a reliable, secure and efficient service.
As a result, delays can occur during deliveries and extra time may be required. If a delivery date has not been arranged by the store please contact our Despatch department directly on 1300 880 370.
Due to the nature of imported goods, there can be delays in the shipment of product. Please note that all booking dates are TENTATIVE only, and are NOT GUARANTEED. If you have provided us with your mobile number our deliveries team will update you on the arrival and the delivery of your furniture via SMS.
Two days prior to your delivery we will SMS all of the important delivery information about your order to your mobile. If all the information is correct you will only need to text back OK. If there are any details that are not correct or you wish to change your delivery date please ring us on 1300 880 370.
If a delivery date has not been arranged by the store please contact our Despatch department directly on the above number.
Please refer to the Terms & Conditions of Delivery of Goods prior to calling our Despatch team. In order to offer our customers a better delivery service these terms and conditions replace any delivery and pickup conditions stated on your order form.
Section 1.01 Terms & Conditions:
The following applies if you elect for a carrier arranged by us to deliver the goods (Carrier) instead of collecting or arranging your own collection and/or delivery of the goods.
(a) It is important that someone is at home to receive delivery of your purchase on the designated day. No specific time of delivery can be provided. A four-hour time frame will be advised but cannot be guaranteed.
(b) The Nick Scali premium delivery and assembly fees are payable on delivery to the Carrier directly. Delivery fees outside of the metropolitan area will be quoted upon request. Additional delivery fees may be incurred, please see collection and delivery advice for further information.
(c) Cash or bank cheque must be used to pay any balance of monies owing no later than 48 hours prior to delivery in store. Personal/ company cheques will NOT be accepted. For your convenience we can accept credit cards in store 48 hours prior to delivery, surcharges will apply. Credit cards will NOT be accepted over the phone. Payment can also be made by BPAY prior to delivery. Please note, any payment by BPAY must be received two weekdays, (Mon-Fri) before 6pm, prior to scheduled delivery date. BPAY Biller Code and Reference is listed on your receipt. If the balance is not paid prior to delivery, as per above payment methods, your goods will be returned to the Distribution Centre and an additional delivery charge will be payable to the Carrier upon re-delivery of the goods.
(d) It is important that sufficient access is available to deliver the goods you have purchased. In cases where the goods need to be disassembled additional charges will apply. Lounges that need to be disassembled and reassembled will incur a minimum cost of $250 including GST plus any additional redelivery fees if the lounge delivered needs to be returned to the Distribution Centre. To avoid re- delivery fees please advise our Despatch Department in advance of any access problems.
(e) Once arrangement for a delivery day is confirmed, there will be a re-delivery charge if no person is at the delivery address on the day of delivery or the delivery is cancelled by the customer on day of delivery.
(f) In the event of a re-delivery due to reasons above in paragraphs (c),(d) or (e) an amount of 2 times delivery fees will apply. Out of metropolitan areas will incur higher redelivery fees (quoted on request).
(g) When receiving goods, please inspect thoroughly before signing “Received in good order” as any claims for scratches, marks, dents or other visible damage will not be accepted.
(h) If you fail to collect or take delivery of goods after 21 days from the date of contact by our Despatch Department, we will treat this as a request by you to cancel the Sales Order and you will forfeit all deposit monies paid.
(i) We make no representations about the Carrier other than those contained in this document and we are not responsible for delivery by the Carrier.
(j) All packing and wrapping materials are your responsibility and will be left at the premises (delivery address).
Section 1.02 COLLECTION OF GOODS:
The following applies if you elect to collect or arrange your own collection and delivery.
(a) We will not accept claims for scratches, indentations, marks, missing colour, or any other visible damage once you have collected the goods from our Distribution Centre. It is important that you inspect the goods thoroughly before taking the goods and signing that the goods were received in good order.
(b) If collecting goods from our Distribution Centre, you must contact our Despatch Department 48 hours prior to pickup and make an appointment. The contact details are on the front of this Sales Order.
(c) Payment must be made in full 48 hours prior to collection of goods at your nearest showroom by cash or bank cheque. Personal cheques will NOT be accepted. For your convenience we can accept credit card in store 48 hours prior to pickup, surcharges may apply. Credit Cards will NOT be accepted over the phone. Payment can also be made by BPAY prior to collection. Please note, any payment by BPAY must be received two weekdays, (Mon-Fri) before 6pm, prior to scheduled collection date. BPAY Biller Code and Reference is listed on your receipt.
(d) Upon collection of goods an original Sales Order & Payment Receipt must be presented.
(e) Our Work Health & Safety policies prohibit our staff from lifting furniture outside our warehouse. Please make sure you have sufficient help to carry and load furniture from our warehouse to your vehicle.
(f) Collection of goods must be made by appointment only and between the hours of 10:00am–12:30pm and 1:30pm–3:00pm, Monday to Thursday only.
Section 1.03 Customer Pick ups
As all Nick Scali stores are showrooms, customer collection of goods purchased from a Nick Scali Store is only available from our Distribution Centres.

Upon arrival at the Distribution Centre
The customer must go to Reception before collection of goods.
The customer must present the original Sales Order & Full Payment Receipt.
For the customer’s security all pickups must be signed for by purchaser (or an authorised representative). We may ask for identification.
The customer must inspect the goods thoroughly. This is to ensure the product is free of scratches, indentations, and marks, missing colour or any other damage.
Once the customer has taken ownership of goods no transport damage claims will be accepted
The customer must ensure they have sufficient help to carry furniture from our warehouse to their vehicle. WHS prohibit Nick Scali staff from lifting furniture outside our warehouse.
The customer may need ropes and blankets to secure product.

5.3. Noisy work or any activity that is deemed unreasonably loud between 11pm and 6am is not prohibited.

5.4. Under Worksafe guidelines, safety is every person’s responsibility.

5.5. Any person who enters the Space Tank Studio premises, understand they are entering a work zone. Caution and common sense must be recognized at all times as power tools and industrial machinery is constantly in use by art and design practitioners.

5.6. Adequate protective clothing and gear must be worn when using machinery and power tools or when in the presence of anybody other than yourself who is using machinery and power tools.

5.7. Many artists and designers use the studio. Common courtesy and decency applies to sharing the fabrication space and machine room.

5.8. We endeavour to always maintain a clean and tidy work environment. This also applies to you. Think of the person who will use the space after you and clean up after yourself! Maintaining a clean, tidy and therefore safe work area is everybody’s responsibility.

5.9. Smoking and Alcohol: No smoking is allowed on the entire premises. Being under the influence of alcohol while operating machinery and power tools is strictly prohibited. Failure to adhere to this condition will result in immediate cancellation of your lease or membership with no refund.

5.10. Any disputes or grievances should be raised with Space Tank Studio management so that the best possible solution can be sought.

8. STUDIO LEASE AND USAGE

8.1. Studios are for fulltime lease only.

8.2. Leases agreements are one year in duration and will commence upon signing of the contract. Lease contracts will be reassessed at the expiry of every year.

8.3. No casual lease agreements will be considered.

8.4. A lease contract will be granted based on availability of studios and waiting list. If you are on the waiting list you will be notified of a studio vacancy according to your position on the waiting list.

8.5. Studio Rent is based on an Australian dollar value per square meter per week basis.

8.6. Price of rent and bond payable will be disclosed to prospective tenants upon filling out a studio application form or upon general enquiry to info@spacetankstudio.com.au

8.7. Space Tank Studio reserves the right to refuse a lease to any prospective tenant for reasons we do not have to disclose.

8.8. Studio tenants can opt to have images of their work and short biography displayed on the Space Tank Studio website under the Artists section of the Studio page and can chose to remove their work at any time. For questions regarding privacy policy and copyright, please see our Privacy Policy.

8.9. General code of conduct applies to all studio tenants. (see above)

8.11. Studio tenants receive access to Space Tank Studio facilities at a discount Membership rate.

8.12. Studio tenants must confirm that they have read and understood our terms and conditions.

7. MACHINERY AND TECHNOLOGY USAGE
Machines and technology are fickle beasts and be warned, when neglected or not respected they can maim. These terms and conditions are primarily for your own safety.

7.1. All Space Tank Studio machinery, technology, work space and communal space are maintained to current best practice Worksafe standards.

7.2. While we take every possible precaution to maintain machinery to the best possible operating standard, if you notice that a machine is not operating properly, blades are blunt, there is damage of any kind or any other issue of concern is observed, you must report immediately to management.

7.3. Individuals may not operate any equipment and machinery unless they have been properly inducted according to Space Tank Studio induction procedures and signed a legal waiver.

7.4. Some specialist equipment at Space Tank Studio may never be used by tenants or members unless under the supervision of a technician. This can include and is not limited to 3D printers and the CNC laser cutting machine.

7.5. If you need to personally operate any specialist equipment without supervision, we can arrange for one on one and group skills training.

8. MEMBERSHIP
Membership terms and conditions have been considered and designed to benefit and protect the usage rights of all concerned. They are based on common sense and principles of fair play. By adhering to these terms and conditions you will help ensure the smooth operation of our service for all members, tenants and residents.

6.1. All Memberships will be considered on an individual personal and project basis to assess the skill level of the member and the right machinery or technology for the job.

6.2. Please carefully consider the length of Membership you require for your project. Each individual works at a different pace and therefore only you can decide how long you need to fulfil your project requirements.

6.3. We can help you asses the time you may need to get your project completed but we cannot be held responsible in any way for the final decision you make.

6.4. Personal Memberships are for personal use only and are not transferable.

6.5. If your project requires an extra set of hands, an assistant can be added to your membership at half the cost.

6.6. Group memberships of three to five people will be considered on a project basis. A group’s impact on the rest of the fabrication area, machine room and technology room will always be carefully considered so as to not infringe on other members time and access.

6.7. Membership Gift Vouchers can also be purchased for a friend, loved one or family member.

6.8. By paying for a membership you agree to Space Tank Studio Terms and conditions.

6.9. Members must undergo an induction on machines they will use and sign an indemnity waiver to show they understand their rights and legal Worksafe responsibilities.

6.10. General code of conduct applies to all Space Tank Studio members. (see above)

6.11. Memberships give you five full eight hour day visits per month. You can break this into ten half days or block all your five days together.

6.12. As a member, you must reserve time slots on the Members project calendar to allocate your preferred time slots as well as machines or technology you wish to use. The members project calendar works on a first come first serve basis.

6.13. Time slots are considered as full days equaling eight hours or half days equaling four hours.

6.14. No time slots of less than four hours will be considered as this requires too much juggling of the calendar when member numbers increase.

6.15. If you know in advance that you cannot make it to one of your reserved time slots, please cancel it with as much notice as possible so that someone else may use it. This will also increase your chances of getting another slot for yourself.

6.16. Failure to turn up on a reserved time slot as well as failure to cancel a time slot within five working days will forfeit that time slot.

6.17. No guarantee is given that you will be able to find a replacement time slot once you cancel. This is entirely dependent on how full the calendar is.

6.18. Members can swap time slots on mutually agreed terms.

6.19. Every member receives access to secure storage facilities.

6.20. Unused membership days lapse when your membership expires so plan your time wisely.

6.21. Members must confirm that they have read and understood our terms and conditions.

9. ARTIST RESIDENCY PROGRAM

7.1. The Space Tank Studio Residency program is offered at the artist residence within the studio complex in North Coburg in Melbourne, Victoria.

7.2. Residencies are available to interstate or international visitors only.

7.3. If you live in Melbourne, you are welcome to lease a studio or purchase a membership but you will not be granted an artist residency.

7.4. Residencies are three months in duration and fall neatly in the seasons of summer, autumn, winter and spring.

7.5. We will consider other time frames but only if current bookings during the period in question allow.

7.6. Availability will be subject to our current waiting list.

7.7. Residents receive access to Space Tank Studio facilities at a discount Membership rate.

7.8. Residency applicants must be professional artists, designers or inventors who can provide proof of five years or more of exhibiting and/or professional practice.

7.9. Residency applications that fall outside the boundaries of section 5.5 may be considered on individual merit.

7.10. Residents must maintain a clean and tidy living environment.

7.11. Artist Residencies are for the purpose of providing abode to the applicant only.

7.12. It is not permitted to hold parties or play excessively loud music that could disturb the peace of other Space Tank Studio tenants and members.

7.13. Rent is to be paid in full and in advance. No part payments will be accepted.

7.14. Residents are required to pay a bond which is fully refundable when the residence is left in the same condition as it was when the applicant took up residence.

7.15. Residents must confirm that they have read and understood our terms and conditions.

8. DISCOUNTS AND SPECIAL OFFERS

8.1. Space Tank Studio may offer discount and special offer events for the purpose of marketing, anniversary events or to highlight major milestones in business development and growth.

8.2. Discounts and special offers events will be governed by a set of terms and conditions that will be set out specifically for that event. Such terms and conditions will be clearly accessible at the time of the event.

8.3. Discounts and special offers relating to any of Space Tank Studio services can be offered at any time and for a specified duration.

8.4. Advertising will be posted via the Space Tank Studio website, mailing list and social media pages and may also be advertised in periodicals and third party websites.

8.5. Space Tank Studio reserves the right to cancel any discounts and special offers due to achieving capacity volumes or for any other reason that may affect the delivery of the service being discounted or offered.

8.6. You may receive discounts and specials offers on a first come first serve basis until capacity volume is reached.

8.7. Your loyalty to Space Tank Studio may be rewarded by way of a special offer or discount. A loyalty reward may be redeemed by the named individual only and is not transferrable.

9. MODIFICATIONS TO SERVICE
To maintain a high quality of service and to meet the requirements of our customers, we need to remain flexible. This may mean we adjust our service from time to time.

10.1. Space Tank Studio reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Space Tank Studio shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

10.2. Machines and technology may be replaced to provide better equipment services.

10.3. Scheduling of members time slots and projects may develop and change to find the best solution for getting as many people building projects as is safe and practical.

10.4. The Space Tank Studio Website and social media sites may change and develop to better meet customer needs.

11. Third party websites

11.1. Please be aware that Space Tank Studio may contain links to third party websites. 12. INTELLECTUAL PROPERTY
Space Tank Studio respects your intellectual property. When you sign up with us you do not automatically give us the rights to use your work in any way. For more information on this matter please refer to our privacy policy.

Users grant of limited licence.
You may choose to have your work displayed in the Gallery section of our website as well as having your project or work ‘featured’ on the front page of our website or social media sites. If you chose this option then the following conditions apply:
12.1. You opt to grant Space Tank Studio a limited license for the royalty-free, unrestricted, world-wide, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, distribute, perform and display Your Content (in whole or part), worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. Such license enables us to feature or use your content in promotional or marketing materials.

12.2. You will remain responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of Your Content.

12.3. By granting Space Tank Studio limited licence, you also warrant that any “moral rights” in posted materials have been waived.

12.4. You acknowledge and agree that the display or use of Your Content shall be in the sole discretion of Space Tank Studio and Your Content may or may not be included on the Space tank Studio website and social media sites for any reason or no reason at all.

Refund Policy
This is the Space Tank Studio refund policy. It applies to the purchase of membership and payment of rent in advance for the artist residency.
2. General refund policy
These conditions apply to all studio tenants, members and artist residents and are designed to protect the service that we provide to all tenants, members and residents.

2.1. If you have paid for a Space Tank Studio Membership, it is assumed that you have considered your project requirements and done your due diligence. Payment of a Space Tank Studio membership plan is final and non-refundable.

2.2. Limitation of usage: Machinery and technology can breakdown at any time. Consumables such as but not limited to blades, belts, drill bits, abrasives, 3D printing powder and resins and CNC laser parts have a limited life span and need replacing at times. We cannot predict when this could happen or who it might affect. For this reason we will not be held responsible for machinery and equipment down time due to maintenance and repair.

2.3. In the advent of machinery or equipment being decommissioned we will endeavour to replace it as soon as possible so as to limit disruption to our service. Full or part refunds to members directly affected will be considered on an individual basis.

2.4. If for some unforseen reason Space Tank Studio must limit access to fabrication space, machinery and equipment and studios then we will do everything we can to give prior warning so that you have the opportunity to adjust your schedule. If no suitable reshuffling of the Member project calendar can be arranged, then a part refund for time lost can be arranged on an individual basis only.

3. Artist Residency
If you cancel your residency it creates a gap in our residency calendar. We may incur extra costs to find a replacement and also face the risk of not being able to fill that residency gap at all. Therefor we will not pay a full 100% refund if you cancel.

3.1. To receive a 60% refund, your notice of cancelation must be received by Space Tank Studio no later than two months before the starting date of your residency period.

3.2. If you cancel less than two months before the starting date of your residency period, you will receive no refund.

3.3. We will under no circumstance pay a full 100% refund due to the reasons stated above.
